UNiQ Cycle Sounds, LLC ("UNiQ Cycle Sounds", "we", "our", "its") is a US business selling Motorcycle Audio and Accessories through direct retail, online, dealer and distributor channels.

1. Use of this web site
1.1 By accessing and using any part of our website, the visitor/consumer ("you") agrees with UNiQ Cycle Sounds, LLC to be bound by these terms. If you do not accept these terms, you may not use the website or access or display any of the information made available to you at the website. These terms for the sale of goods govern any contract for sale that UNiQ Cycle Sounds, LLC enters into with you.

2. Website Links
UNiQ Cycle Sounds, LLC does not accept any liability for any website not under our control, which may act as a portal to our site or be connected by a link with our site or that we connect by a link to.

3. Supply of goods
UNiQ Cycle Sounds, LLC reserves the right to refuse the sale of goods at its discretion.

4. Ordering
4.1 To order goods and comply with all terms and conditions and to be eligible for warranty and guarantee you must be least 18 years of age and place your order via our website (www.uniqcycle.com), telephone (888-864-7721) or from an authorized dealer, distributor or retailer.  For confirmation of authorization, please contact UNiQ Cycle Sounds, LLC at sales@uniqcycle.com.
4.2  Sometimes our product specifications may change, in which case we will offer you a substitute of the same or better quality at the same price.  If you are not happy with the replacement you may return it in accordance with our 30 day money back guarantee.

5. Provision
If any provision of these terms and conditions shall be unlawful, void or for any reason unenforceable then that provision shall be excluded and shall not affect the validity and enforceability of the remaining terms and conditions.

6. Offer and acceptance
6.1 A binding contract of these terms and conditions is formed between you and UNiQ Cycle Sounds, LLC when you receive confirmation from us by e-mail, telephone or other agreed means that your order has been accepted.

7.  Warranty
7.1  UNiQ Cycle Sounds, LLC warrants each new speaker system (Low-Profile and Classic edition) it sells to be free from defective materials and workmanship for a period of five (5) years from the date of purchase.  UNiQ Cycle Sounds, LLC agrees to remedy any such defect or replace the system or system component, at our option, provided the unit is delivered to us, intact, with all transportation charges prepaid to our facility, for a period of five (5) years from the date of sale to the original purchaser.  All other items sold by UNiQ Cycle Sounds are covered under the warranty as described in each items description.  UNiQ Cycle Sounds reserves the right to replace warranted products with one of equal or greater value if the product is non-repairable or no longer available.
7.2 Any product that we determine shows evidence of being used or installed contrary to our instructions, and/or subjected to improper handling, packaging or shipping by the customer, will not be eligible for exchange, refund or warranty consideration.
7.3 We reserve the right to refuse any exceptions to our warranty policy

8. Prices
8.1 UNiQ Cycle Sounds, LLC prices are in US Dollars ($).  All orders to mainland USA will be sent via USPS Priority Mail or FedEx unless otherwise noted.
8.2 UNiQ Cycle Sounds, LLC reserves the right to change any advertised prices at any time.

9. Shipping & Delivery
9.1 UNiQ Cycle Sounds, LLC attempts to ship all orders placed before 1:00pm MST the same day.  We also attempt to ship all orders placed after 1:00pm MST by the next business day.  However, orders can take up to 5 business days from receipt of your order to ship, depending on stock.  If an item is temporarily out of stock and dispatch is anticipated to be greater than 5 business days, UNiQ Cycle Sounds, LLC will notify you by e-mail or telephone.  If this is not satisfactory to you, we will offer you a refund.  You can always check status of your order by visiting our webpage and accessing the order status page (www.uniqcycle.com/orderstatus.asp), or by sending us an email at sales@uniqcycle.com.  All deliveries are subject to payment authorization.  
9.2 If the package you receive has been damaged in shipping, please do not refuse delivery.  Contact UNiQ Cycle Sounds, LLC Customer Service at service@uniqcycle.com so that we may make the necessary arrangements on your behalf.
9.3 If you have any questions concerning delivery please e-mail us at sales@uniqcycle.com or you may call us at 888-864-7721 quoting your order number.
9.4 We reserve the right to require signature for delivery

10. Satisfaction guarantee
10.1 If for any reason you are not 100% satisfied with your UNiQ Cycle Sounds, LLC product or service, you may return it for a refund or exchange. Just return the product to us in like-new condition within 30 days from the date it was shipped to you, and we will refund the full purchase price less shipping costs, which are nonrefundable. UNiQ Cycle Sounds, LLC reserves the right to determine whether a full or partial refund or an exchange is merited based on the condition of the returned merchandise.
10.2 Any product that we determine shows evidence of being used or installed contrary to our instructions, and/or subjected to improper handling, packaging or shipping by the customer, will not be eligible for exchange, refund or warranty consideration.
10.3 We reserve the right to refuse any exceptions to our guarantee policy

11. Payment options
11.1  UNiQ Cycle Sounds, LLC accepts on-line payment with all the major credit and debit cards, including Visa, MasterCard and Discover.  We also accept all credit and debit cards carrying the MasterCard or Visa logos as well as PayPal payments.  If you wish to pay using a check, cash, money order or cashier's check, order will ship once payment has cleared.

12. Net term / Payment by check
If you wish to pay by check under a net term condition, you will need to negotiate this payment term with UNiQ Cycle Sounds, LLC prior to placing any orders.  If you wish to send a check without using net terms, you will need to place an order using the check option and send the check to our offices.  Your order will ship once the check has cleared our bank account and determined to be valid (typically 10-14 days).

13. Your personal information
UNiQ Cycle Sounds, LLC is committed to your privacy.
All personal details that you give us are securely stored.  Any credit card information is encrypted and only the last 4 digits are saved in the event a refund is warranted under our guarantee or other conditions.  We do not supply or sell customers details to any outside organization. We will attempt to take all reasonable care, in so far as it is possible to do so, to keep all details of your order and payment secure, but, in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering.  For more information on our privacy policy, please see http://www.uniqcycle.com/privacy.html.

14. Website
14.1 Terms, conditions, prices and content are subject to change at any time
14.2 Images on our website may not show the actual size of items. All sizes and measurements are approximate but we do try to make sure that they are as accurate as possible. On the rare occasion that there is an error, we will advise you about it as soon as possible.
14.3 We make every attempt to provide accurate information, but UNiQ Cycle Sounds, LLC is not responsible for errors within the website, eBay auctions, Amazon.com or emails.

15. Governing law and jurisdiction
15.1 This contract is subject to the laws of the United States. All disputes arising out of this contract shall be subject to the exclusive jurisdiction of the courts of the United States and the state of Wisconsin. Those who access this website or place orders from other locations are responsible for compliance with their local laws and taxes as applicable.
15.2 Any disputes not resolved by normal complaints procedure will be resolved exclusively in the courts of the United States under United States Law.

Our lawyers made us include this disclaimer. We're sure you'll enjoy our products and will use them responsibly. To help you understand UNiQ Cycle Sound's product liability here's some legal information for you to review:

Failure to follow these guidelines and procedures may cause an unexpected result from the UNiQ Cycle Sounds speaker system or other products and result in loss of control of the motorcycle or riding attention, possibly resulting in serious bodily injury or death!

Do not make adjustments to any aspect of the system while your motorcycle is moving. If adjustments are needed, come to a complete stop, turn off the ignition and secure the motorcycle against tipping or falling. Make any required adjustments then ensure all screws, fittings, components and fasteners are securely tightened. Before resuming travel inspect to ensure all parts are in place and properly secured.

Do not use the system or any products in any way that would interfere with your driving ability, including excess volume levels.

Do not use our products in ways that are contrary to their intended use.

It is the purchaser's responsibility to inspect all screws, fasteners, components and fittings on a daily basis, tighten or replace them as necessary, and to regularly inspect the entire UNiQ Cycle Sounds Speaker System for signs of missing parts, excessive wear, metal fatigue, or imminent failure. Should any of these defects be observed the UNiQ Cycle Speaker System should be immediately removed from the motorcycle and not used again until inspected and repaired by UNiQ Cycle.

All products not directly manufactured or modified by UNiQ Cycle Sounds is the sole responsibility of the original manufacturer.  UNiQ Cycle Sounds takes no responsibility for results from products that are not made directly by us and are just being resold in the original package.  These items are bought and then sold by UNiQ Cycle
